However, if you want to use our products and services, you must register with us by providing certain personal information and, where needed, transaction information. We only use such information to help create and service your account, to provide you with payment of any approved commission advance, to inform you about any promotions that may be of interest to you, and to improve your overall experience.


(a) Personal information you disclose to us


We collect personal information that you voluntarily provide to us when registering on our Sites to obtain our products and services, when participating in activities on our Sites, or otherwise contacting us.


The personal information that we collect depends on the context of your interactions with us and the Sites, the choices you make, and the products and/or services and features you use. The personal information we collect can include the following:


  • Name and Contact Data. We collect your first and last name, email address(es), postal address, phone number, and other similar contact data.

  • Credentials. We collect passwords, password hints, and similar security information used for authentication and account access.

  • Other Data. Information you provide when you contact us (for example for help), when you submit an application to us, and when you obtain services from us (for example: your date of birth, Social Security number, driver’s license number, and/or real estate license number.


In addition to your personal information, we collect transaction information when you request a commission advance. This information can include: buyer/seller names; property address; deposit amount; sale type (condo, new home construction, town home, etc.); purchase price; closing entity (attorney, title company); closing date; and commission earned.


All personal information as well as transaction information that you provide to us must be true, complete, and accurate. In addition, you must notify us in a timely manner if there are any changes to the information that you previously provided to us.


(b) Information automatically collected


In Short: Some information – such as IP address and/or browser and device characteristics – is collected automatically when you visit our Sites.


We automatically collect certain information when you visit, use, or navigate our Sites. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites, and other technical information. This type of information is primarily used to maintain the security and operation of our Sites, and for our internal analytics and reporting purposes.

We use the information we collect or receive:


  • To facilitate account creation and logon process with your Consent. If you choose to link your account with us to a third-party account, we use the information you allowed us to collect from such parties to facilitate the account creation and logon process.

  • To send administrative information to you for Business Purposes, Legal Reasons, and/or possibly for Contractual. We may use your personal information to send you product, service, and new feature information, and/or information about changes to our terms, conditions, and policies.

  • For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Sites, products, services, marketing, and your experience.

Request for Commission Advance –Registration Process


When you request a commission advance, you are required to complete a registration form As part of this process, you are required to provide two types of information: personal information and transaction information. Your personal information is collected for several reasons. For example, Social Security numbers are used for customer identification purposes, as well as to provide you with tax-related information. Other personal information is collected to create a database of your information in order to avoid the need for re-entering the same information each time our products and services are used. We also use this information to contact you about the products and services on our Sites for which you have expressed interest. Transaction information is collected so we can verify that a sale has in fact occurred and that it was valid transaction.


In order for us to properly fulfill our obligation to you in connection with a commission advance request, it may be necessary for us to independently verify each sale contract with the attorney, escrow agent, or title company that is closing the sale. We do this by calling the contact name on the customer’s sales contract. We tell the contact that we are funding a portion of the commission on the sale and we ask that they confirm that they have opened escrow and are acting as the closing entity. We never contact buyers or sellers, and we never share any of your personal information with them.




In Short: We will only share your personal information, in order to comply with applicable laws; to protect your rights; and to fulfill our business obligations, with our trusted services providers and with our sister companies, partners, and joint venture partners; or as otherwise consented to by you.


We only share and disclose your information in the following situations:


  • Compliance with Laws and Court Orders. We may disclose your information where we are legally required to do so in order to comply with applicable laws, governmental requests, a judicial proceeding, court order, or legal process such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements). Should any court order or applicable law require that we disclose your personal information, we will do so only to the extent necessary to comply with such order or law.

  • Vital interests and Legal Rights. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

  • Vendors, Consultants and Other Third-Party Service Providers. We may share your information with third-party vendors such as service providers, contractors, or agents who perform services for us or on our behalf and who require access to such information to do that work. Examples include: loan processing, payment processing, data analysis, email delivery, hosting services, customer service, and marketing efforts.
